TERMS AND CONDITIONS FOR THE SALE OF PUMA PRODUCTS IN MEXICO THROUGH ELECTRONIC MEANS (E-COMMERCE)
1. GENERAL
The following terms and conditions and any other rules related to the sale of Puma products in Mexico through the digital or E-Commerce platform and that are available as provided in these sales conditions (collectively, the "Terms and Conditions"), shall apply to all sales of products that you (the "Customer" or "you") may carry out with PUMA MEXICO SPORT S.A. DE C.V., with address in Av. Vasco de Quiroga No. 3880 LC1 PS4, Col. Santa Fe Cuajimalpa, Zip Code 05348, Mexico City ("referred to herein as "Puma" or "we").
You may contact us online through Puma's website, identified by the domain name https://mx.puma.com/, and any mobile or digital application (collectively, the "Platform") or by telephone at Puma's Customer Service Center (the "Customer Service Center"). You may contact us by any of these means to submit requests, clarifications, complaints or claims in connection with these Terms and Conditions.
These Terms and Conditions apply only to sales made through the Platform to persons within the territory of the United Mexican States at the time of placing the order. The Terms and Conditions applicable to any order placed through the Platform are those in force at the time the corresponding order is placed. For orders placed through the Platform, when you check the box "I have read and accept the Terms and Conditions" in the payment section of the Platform before placing your order with Puma, You accept these Terms and Conditions. If you refuse to accept these Terms and Conditions, you may not order any Puma products from the Platform. Sales made through Puma boutiques (Puma Retail) and/or authorized retailers are not subject to these Terms and Conditions.
We recommend reading these Terms and Conditions, as well as consulting our site periodically to be informed of any changes. Puma may periodically modify the Terms and Conditions, at its sole discretion, pursuant to the new legal provisions and practices applicable to sales through the Platforms.
Where placing an order through the Platform, by checking the box "I have read and accept the Terms and Conditions", you agree to be bound by the Sale Terms and Conditions in effect at the time of placing an order. Persons using or browsing the Platform, without placing orders, shall also be deemed, by virtue of such use, to have agreed to be bound by our Terms and Conditions of use of the Platform and our Privacy Notice, available at https://mx.puma.com/privacy-policy.html, which are incorporated herein by reference. If you do not agree with any change to the Terms and Conditions, you must immediately contact the Customer Service Center to cancel your registration and refrain from ordering any Puma product through the Platform.
2. ELIGIBILITY TO PURCHASE
Only those persons who declare to be of legal age, who have the capacity to bind themselves and who are within the territory of the United Mexican States may make purchases on the Platform. In the case of minors, their parents or guardians must place the orders for them. Any order placed in violation of this provision will be null and void.
By placing an order through the Platform, you represent and warrant that you are a bona fide customer and that you will not deliver, sell, or distribute Puma products or purchase Puma products for commercial purposes or any other commercial gain.
3. PRODUCT AVAILABILITY / QUANTITY
All orders placed through the Platform are subject to availability and acceptance by Puma.
Puma reserves the right to change the variety of items offered on the Platform and may, from time to time, limit the quantity of Puma products that a Customer may order in a single purchase session, without prior notice. Puma also reserves the right to reject at any time, without prior notice, orders that exceed a certain number of authorized products.
The product pages on the Platform can provide you with information about the products that are currently available for sale. Please note that only merchandise that displays the "Add to Shopping Bag" icon is available for sale through the Platform. You may also call the Customer Service Center () and we will provide you with more information on product availability.
4. ACCOUNT REGISTRATION, PERSONAL INFORMATION
To place an order on the Platform, you must register and create an online account on the Platform. To create this account, you will be asked to provide valid and current personal information, such as your legal name, phone number and email address, and to confirm that you are of legal age. The mechanisms for protecting your personal and banking information are mentioned below.
Upon completion of your Platform account registration, you will be allowed to log in to your Platform account and create a permanent username and password. You are responsible for ensuring that your password and account login are kept secret at all times. Puma is not responsible for the misuse of your account in connection with, and/or as a result of, the access and use of your password and account access by a third party.

When placing an order on the Platform, you will be asked to provide personal information as appropriate, such as shipping address, billing address and payment details. Puma or its external suppliers may collect additional information at this time for security and anti-fraud purposes.
You represent and warrant that the personal information you provide is true, valid, complete, and current in all respects, and confirm that you are the person named in the shipment (unless the item is a gift) and will provide the billing information.
If the information you provide on the Platform changes, please update that information directly on the Platform, inform the Customer Service Center or notify Puma at the following e-mail address: service-mx@puma.com, or as set forth in our privacy notice.
5. ORDERS
When placing an order on the Platform, orders will be processed as follows: once you have chosen a product, click on the "Add to Shopping Bag" icon to place this product in your shopping bag. You can then decide to continue shopping for other products and add them to your shopping bag (subject to availability and quantity limits) or proceed to "Pay" by clicking this button. You can also delete one or more products you have selected by clicking on "X" next to the product you have chosen in the Shopping Bag. Once on the payment page, review your order details and personal information (including email, shipping address, billing address and payment information), check the box next to "I have read and agree to the Terms and Conditions". Then click on "Pay Now" to place your order. Puma reserves the right to reject, cancel and terminate orders at any time when there is a justified reason to do so. Good cause shall be deemed to exist if: a dispute arises or exists over the payment of a previous order; Puma reasonably suspects that you have participated or are participating in fraudulent activities or have infringed these Terms and Conditions; or if any of the information provided is false or inaccurate.
6. PRICES, TAXES AND SHIPPING COSTS
All prices shown on the Platform's product pages are in Mexican pesos. Taxes are included in the prices shown on the platform. Puma may decide, at its own discretion, the shipping cost of the products, which may be calculated depending on the purchase amount of the products and the delivery area indicated by the customers. Puma, at its own discretion, may decide not to charge shipping costs in cases where the purchase amount is greater than a certain amount or in cases where promotions are made on certain delivery areas. Puma will not be obliged to ship outside of Mexico or in areas that are out of reach of the parcel companies with which Puma collaborates. Any shipment will be subject to the Shipping Policy below. Puma reserves the right to modify prices and shipping costs at any time without prior notice, except in cases of orders placed and approved.
7. DEBIT OR CREDIT CARD PAYMENT
Puma accepts the following credit cards: Visa, MasterCard and American Express and Visa or MasterCard debit cards. When placing an order on the Platform, you must enter your payment details on the appropriate form. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If your payment card issuer refuses to authorize payment to Puma, delivery of the product will be suspended, and you should contact your card issuer directly to resolve this issue. Puma will not be responsible for any delay or non-delivery due to this cause. In the event that for any reason the card issuer withholds payment to Puma, requests its return, or makes any charge to Puma in connection with your order, Puma may, as the case may be: suspend delivery of the product, without liability; request payment of the amount by any other means; exercise the legal actions necessary to obtain payment, rescission of the sale and/or return of the product; without prejudice to any other action that may correspond to Puma. To process your order, we can perform security checks on your credit/debit card. The total amount of your purchase will be charged to register your order on the platform, and you will be charged the corresponding purchase price. By submitting an offer to purchase Puma products on the Platform, you expressly authorize Puma to perform such security checks, as Puma deems necessary, to transmit or obtain information (including any updated information) about you to or from third parties from time to time, including, but not limited to, your credit card number, to authenticate your identity, to validate your credit card, to obtain a credit card authorization and to authorize individual purchase transactions. Puma takes precautions, including administrative, technical, and physical measures, to protect your personal information from loss, theft, and misuse, as well as from unauthorized access, disclosure, alteration, and destruction. Unfortunately, the transmission of information over the Internet is not completely secure. Although we will implement appropriate measures to protect your personal information, we cannot guarantee the security of the data you transmit; therefore, any transmission is at your own risk and we cannot be held responsible. 7.1 CASH PAYMENT
Payments in cash will be accepted only and exclusively through OXXO PAY following the points below:
• Make a purchase at puma.com
• Choose the option PAY IN CASH WITH OXXO • Receive barcode with the reference number
• Present the code or reference number at the OXXO store preferably
• There will be a time limit of 24 hours from the purchase at puma.com to make the payment at OXXO and confirm the order.
8. REVIEW AND CONFIRMATION
Before placing your order through the Platform, we recommend that you carefully verify and confirm all details, including, but not limited to, the products ordered, the delivery address for the products, shipping costs, payment information, billing information and any other data related to your order.
9. ACKNOWLEDGEMENT AND ORDER CONFIRMATION
Once your order has been placed on the Platform, you will receive an email acknowledgement, acknowledging the details of your order. This order acknowledgement will contain a reference number assigned by Puma. Be sure to save this reference number for future reference regarding your order. This acknowledgement of order is not an acceptance of your order. After transmission of the order acknowledgment, Puma will conduct its legal credit, anti-fraud, security, and related checks and, if acceptable, process your order. Once the legal controls have been completed, Puma will send you an Order Confirmation by email. The confirmation constitutes the acceptance of your order by Puma and indicates the existence of a binding sales agreement.

11. ORDER CONFIRMATION
The Order Acknowledgment and Order Confirmation sent to you by email are considered received when you can access them on your computer or mobile device. The Order Confirmation will be proof of a binding agreement between you and Puma.
12. SHIPPING POLICIES
We only accept orders for delivery to addresses within the Mexican Republic. Puma may restrict the delivery areas if necessary. Delivery areas will be informed to the users through the Platform. Puma will have a standard rate for shipments throughout Mexico, which will be available on its website. Delivery times will be calculated depending on the delivery area and will always be in business days. The estimated delivery time will be from 5 to 7 business days, unless there are force majeure event that justify a longer delivery time, in which case the Customer will be informed about the causes of the delay. When estimating the delivery time of the package, the time for payment approval, address verification and order processing will be considered. Once the order is processed and ready for shipment, we will send you the Order Confirmation by email. When you place an order on the Platform, you will receive an email notification with the information so you can track your order online or by phone. Each delivery package will contain, in addition to your purchased Puma product:
(i) if applicable, all related accessories;
(ii) the warranty card (if the product has a warranty); and/or
(iii) if applicable, the corresponding certificate of authenticity. Puma insures every purchase during the time it is in transit until it is delivered. Puma is not responsible for damage or loss of goods that occur after delivery to the provided shipping address. We require a signature from an adult to confirm acceptance of each delivered Puma product, at which time liability for your purchased products is transferred to you. Customer understands and agrees that evidence of such recipient's signature (or at such delivery address) is evidence of delivery and performance of the sales contract by Puma and transfer of liability to the recipient in the same manner as if the product had been delivered to him/her.
13. RETURN POLICY
To ensure your complete satisfaction, a Customer, or a recipient of a Puma product gift (a "Gift Recipient") may return Puma products in accordance with the return and exchange policy set forth below. All returns and exchanges are subject to the Terms and Conditions set out below. Puma may refuse returns of Puma products that do not comply with the conditions and deadlines set forth below.
13.1 Return period
Puma products purchased through the Puma platform can be returned for a refund that can be requested within sixty (60) days from the date of delivery of the product only in the event that any of the products have manufacturing defects. For returns for a reason other than manufacturing defects, the consumer may only request a return for a refund within thirty (30) days after the date of delivery of the product.
13.2 Return process
In case of returns, products must be in their original state, unused and accompanied by the corresponding purchase receipt. Items that show signs of wear and tear cannot be exchanged, returned, or refunded. The online return option will only be available for orders placed on the Platforms. If a Customer or Gift Recipient wishes to return a product purchased online, that person should contact our Customer Service, who will generate a label that will be sent to the Customer, so that he or she can return the relevant product. The Client may only make 01 return per order, that is, if the Client generates a purchase and subsequently decides to return any of the products purchased from that order, he may only do so on a single occasion.
13.3 Conditions for returning a product
Puma products must be returned in new and unused condition, in perfect condition, with all protective materials in place, labels and stickers, as well as the original Puma box and delivery package, including all accessories and documents. Puma will not accept any return if the product shows signs of wear and tear or has been used or altered from its original condition. All returns will be subject to strict quality control by Puma to ensure that the returned products meet these requirements. If the products do not meet the quality control standards, Puma will refuse the return and the products will be sent back to the Customer or the Gift Recipient, as appropriate. If the returned product complies with the quality Control, Puma will proceed with the corresponding refund or exchange. The Client may only make 01 return per order, that is, if the Client generates a purchase and subsequently decides to return any of the products purchased from that order, he may only do so on a single occasion.
13.4 Refunds
The value of purchases made with a debit or credit card will be credited to the original payment method. For returns of orders generated through OXXO Pay, it is necessary to send the form requested by customer service, it will be sent to the banking institution. Once the refund is ready, customer service will send an email to the user to confirm its availability. If you have any questions about refund processing times, please check directly with your financial institution for refund processing times.
13.5. Exchanges
We do not make exchanges directly. If the Customer wishes to exchange an item, he/she must follow the steps of our refund process and place a new order. Customer will receive a prepaid return shipping label and will receive his/her new order via free standard shipping. For assistance with a new order of a different size or color, Customer should contact our Customer Service.
13.6. Defective products
Puma is extremely careful to ensure that each product strictly meets our quality criteria. In the event of receiving, a product that appears to be damaged, you may return it to Puma in accordance with the return policy. Upon receipt, Puma may classify the returned product as a defective product. Please note that items that are damaged as a result of wear and tear or use are not considered defective. If Puma declares its product to be defective, the following solutions will be proposed to the Customer or the Gift Recipient, as appropriate:
1. i) Puma may send you the exact same size product, subject to availability,
1. ii) Puma may propose an exchange for another Puma product of equivalent or greater value, in which case the initial price will be discounted, and you will only be asked to pay the difference; or
iii) You, as a Customer, may request a refund of the full price of your initial purchase. This clause is not a warranty policy; if the product has a warranty, it shall be governed by the terms and conditions contained in the relevant policy.
13.7. Warranties
Where applicable, Puma undertakes to deliver each product together with its respective warranty, which may be delivered together with the purchase ticket and/or by e-mail. In case the consumer needs to make the warranty valid, he/she must follow the instructions contained in the warranty and contact the Customer Service Center, either by phone or by e-mail. The specific conditions for the validity of the warranty will be defined in the product's warranty policy or on its packaging.
14. PRODUCT DESCRIPTION
We try to ensure that the information, including product descriptions, dimensions, and colors, provided on the Platform, in advertisements or catalogs, is accurate and complete. The information described in the Platforms will be included in Spanish, without prejudice to the fact that certain information may appear in another language. 15. LIMITATION OF LIABILITY
Our liability is limited to the provisions of these Terms and Conditions and therefore, to the extent permitted by law, we disclaim and exclude any other liability. Our liability to you under any defect in the products, delay in shipping, mis-ordering or any other error, shall in no event exceed one hundred percent (100%) of the price of the product(s) in your order. We are not responsible for any damage or loss caused by failures in the system, the server, or the Internet as well as any virus that could infect your computer as a result of accessing or using the platform. Puma does not guarantee access and continued or uninterrupted use of the Platform.
16. GENERAL PROVISIONS
If any provision, or part of a provision, of these Terms and Conditions is held to be illegal, invalid, or unenforceable, the remaining provisions of these Terms and Conditions shall not be affected and shall continue to be fully valid, binding, and enforceable. These Terms and Conditions (and the associated terms incorporated by reference) constitute the entire agreement between you and us in connection with the ordering of products or services, and supersede and extinguish all prior agreements, draft agreements, understandings, commitments, or collateral contracts of any nature made by the parties, whether oral or written, in connection with such subject matter.
17. GOVERNING LAW
For operations within the Mexican Republic, these Terms and Conditions shall be governed by and construed pursuant to the laws of the United Mexican States. Any dispute, controversy or claim arising out of or relating to the Terms and Conditions, including the validity, invalidity, breach or termination of the Terms and Conditions, or any product purchased from Puma through the Platform may be submitted to conciliation before the Federal Consumer Protection Agency (Procuraduría Federal del Consumidor). We are not responsible for any failure or delay in performance or fulfillment of our obligations under these Terms and Conditions arising from acts of God or force majeure, or any cause beyond our control. The waiver by us of any breach of any provision of these Terms and Conditions shall not be construed as a waiver of any other or subsequent breach. This agreement is between us and You. No other person shall have the right to enforce any of its terms.
18. CONFORMITY WITH THE TERMS AND CONDITIONS
Access to, use of and/or the conclusion of transactions through this website constitutes a tacit acceptance of these terms and conditions, which shall be understood as read and duly accepted.
